The Lahore High Court has confirmed the pre-arrest bail of a citizen, Muhammad Umair Riaz, after his wife filed a criminal case against him for selling a car given to her as dowry.

Justice Tariq Mehmood Bajwa issued the written order accepting the husband’s interim bail request, shifting the marital dispute back toward civil judicial channels.

The legal confrontation escalated significantly when the wife filed a formal complaint accusing her husband of fraud and a breach of trust. She alleged that the vehicle, which was registered under her name but utilized by her husband, had been kept with him in trust and was subsequently sold without her authorization.

In his defense, the petitioner argued that the criminal charges were malicious and entirely manufactured from ongoing domestic and marital friction.

He maintained that the dispute was strictly civil, noting that his wife had already filed a separate lawsuit in the family court seeking the recovery of her dowry articles. The defense asserted that the criminal case regarding the vehicle’s sale was leveraged purely as a tactical tool amid their deteriorating personal relationship.

The Lahore High Court ultimately observed that the criminal case appeared to be a direct consequence of the couple’s broken marital ties rather than actual criminal intent. By solidifying the husband’s pre-arrest protections, the court emphasized that these underlying domestic grievances are already undergoing proper scrutiny within the family court system.

The ruling effectively restricts the immediate arrest of the husband as the broader legal proceedings regarding asset distribution and their marital separation continue to move forward.
